1. Service Content and Quality
1.1. The server service allows the Client to host its website, e-mail, and databases on the Service Provider’s server (Virtual Server) or to use a private server resource (VPS).
1.2. The Service Provider ensures the functioning of the server hardware, network connection, and operating system, and shall make its best efforts to ensure the high availability of the server services.
2. Prohibited Activities and Content
2.1. It is strictly prohibited to use the server service for activities that conflict with the laws of the Republic of Estonia or good practice, including, but not limited to:
- Distribution of terrorist content (material that incites or glorifies terrorist acts, or promotes extremist groups).
- Distribution of malware (viruses, trojans, ransomware) and hosting of C&C servers.
- Phishing (phishing pages) and fraud.
- Illegal distribution of copyrighted material.
- Execution of network attacks (DoS/DDoS) or network scanning.
2.2. Spam (Zero Tolerance): The Service Provider enforces a zero-tolerance policy regarding spam. It is strictly prohibited to send unsolicited mass e-mails to persons who have not given their explicit consent to receive them.
2.3. IP Reputation: If, due to the Client’s activities (including an unsecured website or a compromised e-mail account), the Service Provider’s IP address is placed on a blacklist (RBL), the Service Provider reserves the right to demand a contractual penalty of 50 EUR from the Client per incident and to immediately suspend the server service.
2.4. The Service Provider does not use automated filters or monitoring equipment to detect terrorist content, but responds to notifications (Notice-and-Action).
3. Resource Usage (Fair Use)
3.1. The virtual server service is a shared resource. The Client shall not burden the server (CPU, RAM, I/O) to an extent that disrupts the functioning of the server services for other clients.
3.2. The Service Provider reserves the right to limit or suspend processes that cause an unreasonable load (e.g., cryptocurrency mining, poorly optimized scripts, proxy servers).
4. Security and Liability
4.1. Client’s Liability: The Client shall be fully liable for regularly updating its web applications (e.g., WordPress, Joomla) and associated add-ons. Eliminating the consequences of attacks executed through security vulnerabilities shall be the sole obligation of the Client.
4.2. Retention of Logs: In the event of a breach of the terms of the server service or a cyber attack, the Service Provider may retain evidence (server logs, IP addresses) and share such evidence with law enforcement authorities (e.g., the Police, CERT-EE) in accordance with applicable law, even if the Client has terminated the agreement.
4.3. Backups: The Service Provider performs regular server backups for disaster recovery purposes, but shall not be liable for the preservation or integrity of the Client’s data. The Client is obliged to maintain independent backups of its data outside the Service Provider’s server.
